Terms and Conditions – Web Hosting Services

These Terms and Conditions (“Terms”) govern the provision of web hosting services (“Services”) by Digital Creative Hub (“we”, “us”, “our”) to the customer (“you”, “your”). By purchasing or using our Services, you agree to be bound by these Terms.
1. Services Provided
We provide shared and/or managed web hosting services on monthly and yearly subscription plans. The specific features of your chosen plan are detailed on our website at the time of purchase.
We reserve the right to update, modify or discontinue any part of our Services. Where changes materially affect your hosting plan, you will be notified in advance.
2. Billing & Payments
2.1 Yearly Hosting Plans

Yearly plans are billed automatically on the same calendar date each year.

The renewal fee will be charged to the payment method associated with your account.

You will continue to be billed annually unless you cancel in accordance with Section 3.
2.2 Monthly Hosting Plans
-
Monthly plans are billed automatically on the same calendar date each month.

The renewal fee will be charged to your saved payment method.
-
You will continue to be billed monthly unless cancelled in accordance with Section 3.
2.3 Payment Failure
If a renewal payment fails, we may:
-
attempt to re-charge the payment method on file;
-
temporarily suspend your hosting service;
-
terminate your hosting account if payment is not received within 7 days of the renewal date.
You remain responsible for all outstanding amounts.
3. Cancellation
-
You may cancel your hosting plan at any time.
-
Cancellations must be made prior to the renewal date for monthly or yearly plans.

If you fail to cancel before the renewal date, the renewal payment is deemed due and is non-refundable (except within the cooling-off period described below).
Upon cancellation:
-
Your hosting service will remain active until the end of the paid period.
-
After that, all data associated with your website, emails or databases may be permanently deleted.
4. Cooling-Off Period & Refund Policy
4.1 14-Day Cooling-Off Period (Consumer Rights)
All hosting plan purchases include a 14-day cooling-off period under UK consumer law.
You may request a cancellation and refund within 14 days of purchase.
4.2 Deductions for Services Already Performed
If our staff have performed any work during this period — including but not limited to:
-
transferring your website to our server,
-
transferring or setting up your email accounts,
-
transferring your domain,
-
configuration or migration work,
We reserve the right to deduct charges based on our standard hourly rate of £32 per hour, billed in full or part hours as applicable.
4.3 Refunds After 14 Days
After the 14-day cooling-off period, no refunds are issued on hosting services.
This applies to both:
-
monthly plans, and
-
yearly plans (regardless of remaining time).
5. Customer Responsibilities
You agree to:
-
keep your login credentials secure and confidential;
-
maintain up-to-date backups of your website and email data (unless your plan includes managed backups);
-
ensure your website content complies with applicable UK laws and does not contain material that is unlawful, harmful, or abusive;
-
ensure your site does not violate copyright or intellectual property rights.
You are responsible for any content, actions, or traffic generated from your hosting account.
6. Prohibited Use
You may not use our Services for:
-
hosting malware, viruses, phishing pages or any malicious software;
-
spamming or mass-mailing without proper opt-in consent;
-
storing illegal material;
-
activities that disrupt our servers or affect other customers.
We reserve the right to suspend or terminate accounts engaged in prohibited activities without notice.
7. Service Availability & Liability
We aim to provide a reliable hosting environment, but uninterrupted availability cannot be guaranteed.
To the fullest extent permitted by UK law:

We are not liable for any loss of data, revenue, profit, or business arising from downtime, service interruptions, or data corruption.

Our total liability is limited to the amount paid by you for hosting services during the 12-month period preceding any claim.
You are responsible for maintaining independent backups unless your plan explicitly includes managed backups.
8. Domain Names
If you register or transfer a domain through us, you agree to the relevant registry’s terms.
Domain renewals are your responsibility. Failure to renew may result in the domain being suspended or lost.
9. Data Protection & Privacy
We process your personal data in accordance with our Privacy Policy and UK GDPR.
We do not access your website content unless required for support, migration, or legal compliance.
10. Changes to These Terms
We may update these Terms from time to time. If changes materially affect your rights or obligations, we will provide advance notice by email.
Your continued use of our Services constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
12. Retainer Packages
Each of our retainer packages are charged automatically on the same date each month. We ask for one month’s notice, if either side wish to stop the retainer package. If payment is not met within 7 days of your renewal date, all works will stop until payment is met again, which may negatively effect your website’s SEO rankings.
